<\/span><\/strong><strong><span style=\"color: #013ca6;\">Computer-Implemented Simulations can be patentable<\/span><\/strong><\/h2>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\"><span style=\"color: #013ca6;\"><a class=\"link-build-content\" style=\"color: #013ca6;\" href=\"https:\/\/documents.epo.org\/projects\/babylon\/eponet.nsf\/0\/99f4b971c9e3eb2fc125869400340179\/$FILE\/G_1_19_decision_of_the_Enlarged_Board_of_Appeal_of_10_March_2021_en.pdf\" target=\"_blank\" rel=\"noopener\"><b><u>On March 10, 2021, the EPO\u2019s Enlarged Board of Appeal issued its long-awaited decision in case<\/u><\/b><\/a>\u00a0<b>G1\/19<\/b><\/span>\u00a0relating to the patentability at the EPO of computer-implemented simulations.<\/p>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\">The underlying case related to the patentability of a computer-implemented simulation of the motion of people or the like through a physical environment (e.g. a railway station). \u00a0In view of the fact that the simulated system was not a machine, technical process or other technical system, it seemed doubtful that this particular subject matter would meet the EPO\u2019s strict standards for technical character, which generally comes into play during the assessment of inventive step.<\/p>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\">Moreover, many practitioners had feared that the consideration of this case by the Enlarged Board of Appeal might lead to a negative determination in regard to the patentability of computer-implemented simulations, or computer modelling, in general. \u00a0This concern was heightened by the fact that, before case\u00a0<span style=\"color: #013ca6;\"><b>G1\/19<\/b>\u00a0<\/span>was decided, it was cited by EPO Examiners as a reason for delaying examination of inventive step in many EP case files where the invention related to a computer-implemented simulation or computer modelling, even in cases where the simulated system was a technical entity.<\/p>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\">Happily, decision\u00a0<span style=\"color: #013ca6;\"><b>G1\/19<\/b><\/span>\u00a0is more favourable than practitioners had feared and, in particular, there is no wholesale exclusion of computer-implemented simulations or modelling from patent protection at the EPO. \u201cNo group of computer-implemented inventions can be a priori excluded from patent protection.\u201d (<span style=\"color: #013ca6;\"><b>point 139 of the Decision<\/b><\/span>).<\/p>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\">In\u00a0<span style=\"color: #013ca6;\"><b>G1\/19<\/b><\/span>, the Enlarged Board of Appeal has confirmed that the approach to be used for assessing inventive step of computer-implemented simulations\/modelling is the same as that which is generally applied by the EPO when judging the inventive step of any computer-implemented invention: \u201cLike any other computer-implemented inventions, numerical simulations may be patentable if an inventive step can be based on features contributing to the technical character of the claimed simulation method\u201d (<span style=\"color: #013ca6;\"><b>point 136 of the Decision<\/b><\/span>).<\/p>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\">The general EPO approach to assessment of inventive step of computer-implemented inventions, the COMVIK approach, is based on\u00a0<span style=\"color: #013ca6;\"><a class=\"link-build-content\" style=\"color: #013ca6;\" href=\"https:\/\/www.epo.org\/law-practice\/case-law-appeals\/pdf\/t000641ep1.pdf\" target=\"_blank\" rel=\"noopener\"><b><u>decision T641\/00<\/u><\/b><\/a><\/span>. \u00a0According to the COMVIK approach, only claim integers that contribute to the technical character of the claimed invention can contribute to inventive step. \u00a0A claim integer that is non-technical per se may, in some circumstances, be taken into account when evaluating inventive step, if in the context of the invention, it contributes \u201cto producing a technical effect serving a technical purpose, thereby contributing to the technical character of the invention\u201d (<span style=\"color: #013ca6;\"><a class=\"link-build-content\" style=\"color: #013ca6;\" href=\"https:\/\/www.epo.org\/law-practice\/legal-texts\/html\/guidelines\/e\/g_vii_5_4.htm\" target=\"_blank\" rel=\"noopener\"><b><u>EPO Guidelines for Examination, Part G, Chapter VII, 5.4<\/u><\/b><\/a><\/span>).<\/p>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\">The Enlarged Board made clear that the technical nature of the modelled\/simulated system is not conclusive as to technical character. \u00a0Indeed, the second question of law decided by the Enlarged Board included an instruction that, for the assessment of inventive step: \u201cit is not a sufficient condition that the simulation is based, in whole or in part, on technical principles underlying the simulated system or process\u201d. \u00a0Indeed,\u00a0<span style=\"color: #013ca6;\"><b>point 140 of the decision<\/b><\/span>\u00a0states that: \u201cthe simulation of non-technical processes may contribute to the technical character of an invention. On the other hand, it may be that the simulation of a technical system does not contribute to it.\u201d<\/p>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\">However, aspects of the model \u201cmay contribute to technicality if, for example,<\/p>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\">&#8211; they are a reason for adapting the computer or its functioning<span style=\"color: #013ca6;\"><b>*<\/b><\/span>, or<\/p>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\">&#8211; if they form the basis for a further technical use of the outcomes of the simulation (e.g. a use having an impact on physical reality)\u201d<\/p>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\">(<span style=\"color: #013ca6;\"><b>point 137 of the Decision<\/b><\/span>).<\/p>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\"><i>[<\/i><span style=\"color: #013ca6;\"><i><b>*<\/b><\/i><\/span><i><span style=\"color: #013ca6;\">\u00a0<\/span>we infer that the \u201cadapting\u201d of the computer or its functioning mentioned here should involve a technical solution to a technical problem in order for the EPO to accept that there is a true contribution to technicality.]<\/i><\/p>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\">Also, the Enlarged Board remarked that \u201cTechnical improvements to simulations as such could also be achieved by particular details of the implementing software\u201d (<span style=\"color: #013ca6;\"><b>point 115 of the decision<\/b><\/span>). \u00a0However, \u201cany such implementation details concerning hardware or software would have to be disclosed in the patent application\u201d and \u201cIn order to rely [for inventive step] on any technical improvement based on implementation details\u2026such implementation details should appear as limiting features in the pertinent patent claims\u201d (<span style=\"color: #013ca6;\"><b>point 116 of the decision<\/b><\/span>).<\/p>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\">Interestingly, the Enlarged Board clarified that the legal answers they have provided in\u00a0<b><span style=\"color: #013ca6;\">G1\/19<\/span>\u00a0<\/b>apply even in the case of a computer-implemented simulation that is claimed as part of a design process, e.g. for verifying a design.<\/p>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\"><span style=\"color: #013ca6;\"><b>Conclusion:<\/b>\u00a0<\/span>It follows from the Enlarged Board of Appeal decision<span style=\"color: #013ca6;\">\u00a0<b>G1\/19<\/b>\u00a0<\/span>that it is possible to patent computer-implemented simulations and computer modelling at the EPO provided that the claimed invention includes features which contribute to solving a technical problem. \u00a0The required features might be found in some real-world effect produced by the output from the modelling\/simulation but it seems likely that more often the required technical character will derive from an aspect of the implementation of the simulation\/modelling in software\/hardware, notably some implementation detail(s) which adapt the computer or its functioning in a way that overcomes a technical problem. \u00a0It is important to ensure that such implementation details, and the problems they solve, are disclosed in the specification.<\/p>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\"><span style=\"color: #013ca6;\"><b>For reference:<\/b>\u00a0<\/span>Here are the answers that the Enlarged Board of Appeal gave to the questions of law referred to it in\u00a0<span style=\"color: #013ca6;\"><b>G1\/19<\/b><\/span>:<\/p>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\">1. A computer-implemented simulation of a technical system or process that is claimed as such can, for the purpose of assessing inventive step, solve a technical problem by producing a technical effect going beyond the simulation\u2019s implementation on a computer.<\/p>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\">2. For that assessment it is not a sufficient condition that the simulation is based, in whole or in part, on technical principles underlying the simulated system or process.<\/p>\n<p class=\"text-build-content\" data-testid=\"MtRtXsMRrsQu\">3.
