target=\"_blank\" rel=\"noopener\">Judgment dated August 30, 2023<\/a><\/span>, the <strong>French Supreme Court<\/strong> (\u201cCour de Cassation\u201d) provided an important clarification regarding the <strong>filing of divisional patent applications <\/strong>from French national patent applications.<\/p>\n<p data-testid=\"MtRtXsMRrsQu\">The Supreme Court <strong>considered that a divisional patent application could be filed until the payment of the grant and printing fees of the patent application, from which the divisional patent application directly derives.<\/strong><\/p>\n<p data-testid=\"MtRtXsMRrsQu\">This ruling <strong>calls into question the practice of the French Patent Office (\u201cINPI\u201d)<\/strong>, which considered since 2011 that the filing of a divisional patent application was only possible until payment of the grant and printing fees of the first patent application before any division.<\/p>\n<p data-testid=\"MtRtXsMRrsQu\">Therefore, in the event of the <strong>filing of successive divisional patent applications<\/strong> (for example, filing of a divisional patent application <span style=\"color: #013ca6;\">(B)<\/span> on the basis of a patent application <span style=\"color: #013ca6;\">(A)<\/span>, then filing of a divisional patent application <span style=\"color: #013ca6;\">(C)<\/span> on the basis of said divisional patent application <span style=\"color: #013ca6;\">(B)<\/span>), the Judgment of the Supreme Court confirms that it is possible to file the second divisional patent application <span style=\"color: #013ca6;\">(C)<\/span> until payment of the grant and printing fee of its parent application <span style=\"color: #013ca6;\">(B)<\/span>, and not until the payment of the grant and printing fees of the first patent application <span style=\"color: #013ca6;\">(A)<\/span>, as previously required by the French Patent Office since 2011.<\/p>\n<p data-testid=\"MtRtXsMRrsQu\"><img loading=\"lazy\" articles <span style=\"color: #013ca6;\"><a style=\"color: #013ca6;\" href=\"http:\/\/xh4uh.mjt.lu\/lnk\/AUEAAM_NEXgAAAAAAAAAACWdi6EAAAAAwsIAAAAAABRUuQBk-Z4yuvO0LtzaSDulYoG_LBA6tgAUMcs\/3\/ZH0kBdDMQDMQKPvqd_ZISw\/aHR0cHM6Ly93d3cubGVnaWZyYW5jZS5nb3V2LmZyL2NvZGVzL2FydGljbGVfbGMvTEVHSUFSVEkwMDAwMDYyNzk0Mjc\" target=\"_blank\" rel=\"noopener\">L. 612-4<\/a><\/span> and <span style=\"color: #013ca6;\"><a style=\"color: #013ca6;\" href=\"http:\/\/xh4uh.mjt.lu\/lnk\/AUEAAM_NEXgAAAAAAAAAACWdi6EAAAAAwsIAAAAAABRUuQBk-Z4yuvO0LtzaSDulYoG_LBA6tgAUMcs\/4\/FsQN8OqpJVRD9dGp8Lgf5A\/aHR0cHM6Ly93d3cubGVnaWZyYW5jZS5nb3V2LmZyL2NvZGVzL2FydGljbGVfbGMvTEVHSUFSVEkwMDAwMDYyODA0MzI\" target=\"_blank\" rel=\"noopener\">R. 612-34<\/a><\/span> of the French IP Code (\u201cCode de la propri\u00e9t\u00e9 intellectuelle\u201d) is consistent with the practice that was in place at the INPI until 2011 and with the interpretation of the European Patent Convention (EPC) as implemented by the European Patent Office (EPO), leading to a welcome harmonization of practices at the European level.<\/p>\n<p data-testid=\"MtRtXsMRrsQu\">This Judgment from the Commercial Chamber of the Court of Cassation is published in the official Bulletin and could lead to a modification of the related
