{"id":2812,"date":"2016-12-04T18:01:25","date_gmt":"2016-12-04T17:01:25","guid":{"rendered":"https:\/\/www.bdl-ip.com\/\/?p=2812"},"modified":"2020-04-21T13:26:14","modified_gmt":"2020-04-21T11:26:14","slug":"2016-12-enlarged-board-of-appeal-decision-g1-15-on-partial-priority-issued","status":"publish","type":"post","link":"https:\/\/www.bdl-ip.com\/en\/2016-12-enlarged-board-of-appeal-decision-g1-15-on-partial-priority-issued\/","title":{"rendered":"2016\/12 > Enlarged board of appeal decision G1\/15 on partial priority issued"},"content":{"rendered":"<p>The Enlarged Board of Appeal of the European Patent Office has just given its decision in case G1\/15 concerning partial priority (the questions referred to the EBA are available\u00a0<a class=\"icone fichier pdf broken\" title=\" (PDF)\" href=\"http:\/\/www.epo.org\/law-practice\/case-law-appeals\/pdf\/t130557ex1.pdf\">here\u00a0(PDF)<\/a>).<\/p>\n<p>According to the order of the decision, entitlement to partial priority may not be refused for a claim in respect of subject matter embraced by that claim that is disclosed directly, or at least implicitly, unambiguously and in an enabling manner in the priority application.\u00a0 Provided that the disclosure in the priority application is enabling, there are no other substantive requirements in order for partial priority to be established.<\/p>\n<p>The Enlarged Board of Appeal thus considers that partial priority can validly be claimed provided the criteria set out in decision\u00a0<a class=\"icone fichier pdf broken\" title=\" (PDF)\" href=\"http:\/\/documents.epo.org\/projects\/babylon\/eponet.nsf\/0\/D616F77B3B0BA362C12572C8006F2E6E\/$File\/10_4131.pdf\">G2\/98\u00a0(PDF)<\/a>\u00a0are met.<\/p>\n<p>It now remains to be seen how the Boards of Appeal will apply G1\/15, and whether the so-called \u201cpoisonous divisional\u201d problem will disappear.<\/p>\n<p>Further comments will be posted once the reasons for the decision are available.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Enlarged Board of Appeal of the European Patent Office has just given its decision in case G1\/15 concerning partial priority (the questions referred to the EBA are available\u00a0here\u00a0(PDF)).
